The countries benefiting from this tariff relief include Argentina, Bangladesh, Cambodia, Ecuador, El Salvador, members of the European Union, Guatemala, Indonesia, Japan, Jordan, Malaysia, North Macedonia, South Korea, Switzerland, Liechtenstein, Taiwan, Thailand, the United Kingdom, and Vietnam. The US Commerce Department has published this list in the Federal Register as it prepares to impose a 100% tariff on certain patented pharmaceutical imports starting September 29, 2023.
This tariff exemption applies to drugs designated for rare diseases, infertility treatments, cell therapies, gene therapies, antibody-drug conjugates (ADCs), and animal pharmaceuticals. The components of these drugs will also qualify for a zero percent tariff rate. This exemption is part of the implementation of a proclamation issued by former President Donald Trump on April 2, which aimed to encourage domestic production of pharmaceuticals by imposing tariffs on imported patented drugs and their ingredients.
The upcoming 100% tariff will affect specified patented pharmaceuticals and ingredients, with the first phase taking effect on July 31 for certain companies, while others will be impacted from September 29. Notably, generic pharmaceutical products and their associated ingredients are not subject to these tariffs, according to the Commerce Department's notice. The notice also includes technical corrections to the original proclamation, refining the definitions of pharmaceutical articles to ensure clarity regarding what is included.
