In a significant development, the Supreme Court of India has instructed the Election Commission of India (ECI) to resolve the ongoing dispute regarding the election symbol of the All India Trinamool Congress (AITC) within a four-month timeframe. This directive comes amidst a conflict between two factions of the party, led by Mamata Banerjee and Ritabrata Banerjee, respectively. The Court has mandated that both parties submit their affidavits within four weeks, after which the ECI is required to make a decision within three months.
The dispute escalated following the ECI's interim order on September 17, which froze the AITC name and its 'Flowers & Grass' symbol due to competing claims from both factions. Mamata Banerjee, the former Chief Minister of West Bengal and founder of the party, filed a writ petition challenging this decision. During a recent hearing, her counsel, Senior Advocate Kapil Sibal, emphasized the need for an expedited resolution, noting that the interim order was not being contested.
During the proceedings, Senior Advocate Dama Seshadri Naidu, representing the ECI, indicated that the resolution of symbol disputes often requires considerable time due to the volume of affidavits expected from party workers. Justice Joymalya Bagchi suggested the use of artificial intelligence tools to expedite the process, highlighting that three months had already elapsed since the matter was referred to the ECI.
The ECI's interim measures have resulted in the allocation of new names and symbols to both factions. Mamata Banerjee's faction has been designated as “Mamata All India Trinamool Congress” with the 'Football Player' symbol, while the Ritabrata Banerjee faction is now known as “Democratic Trinamool Congress” with the 'Envelope' symbol. These arrangements are set to apply to the upcoming bye-elections, including those in Nandigram and Rejinagar scheduled for October 6.
As the situation unfolds, the Supreme Court's directive aims to bring clarity to the ongoing dispute and ensure that the ECI adheres to the established timeline. The resolution of this matter is crucial not only for the factions involved but also for the political landscape in West Bengal as the state prepares for the forthcoming elections.
